10th Amendment.

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

In 1791 the Bill of Rights was ratified and it included the 10th Amendment.

The States are given all powers except those expressly given not extended. American jurisprudence has slowly but effectively chip away all powers and rights from the State. The modern takeover by the courts has grown out of the slaughterhouse cases of 1870's. In these cases the court understood that their are several themes that must be ruled uniformly throughout the nation. The cases related to the containment of meat houses to certain districts of town in order to prevent the spread of diseases and bacteria normally associated with the butchering of animals.

Since these cases gave Federal judges the capacity to regulate over powers given to the States, jurisprudence has continued through this slippery slope. Today, Federal judges enjoy an abundance of powers over State legislatures since the idea of Judicial Supremacy has infested American politics. 

The 10th Amendment is a victim to this takeover, since the States are now less and less able to decide on how to better develop their growth. The Federal government can selectively decide how America will handle a particular issue, regardless of the opinion of the people.

In fact, the Supreme Court, which now typically decides cases on a 5 to 4 basis, hence one lawyer gets to decide how the whole of America shall be governed. The idea of Judicial Supremacy is ludacris, and the States shall fight back to get what is rightfully theirs.
